It's legal for them to put up their cash, credit, CD's, Bonds or any other asset as collateral. What you offer them is a matter of negotiation. It depends on the kinds of yields you can get on the notes and what rate they are receiving on the CD's or rate they would need to pay on the line of credit. That depends on their needs. Some investors might want a little more cash flow, so you can offer a couple percent above what they are receiving. Others might want to just joint venture the profits with you. There are lots of variables and it depends on you, the investor, the collateral, etc.
